Exclusion from Liability
- Contents of the Online Offer
The SAS (Security Advisory Services) cannot be held liable for the topicality, correctness, completeness or quality of the information provided. Liability claims against SAS (Security Advisory Services) that refer to damages of a material or non-material kind caused by the use or non-use of the information provided or by the use of faulty and incomplete information are excluded in principle unless deliberate or gross negligent conduct on the part of the SAS (Security Advisory Services) can be proven. All offers are subject to change without notice and not binding. SAS (Security Advisory Services) explicitly reserves the right to change, amend, delete parts of the pages or the entire offer without prior notice or to stop the publication temporarily or completely.
- Cross References and Links
As to direct or indirect cross references to foreign web sides ("hyperlinks") that are outside the area of responsibility of SAS (Security Advisory Services) a legal liability would come into effect only if SAS (Security Advisory Services) knew about the contents and had the technical tools and could reasonably be expected to prevent the use in the event of illegal contents. SAS (Security Advisory Services) herewith explicitly states that the pages to be linked showed no visible illegal contents at the time the links were set. SAS (Security Advisory Services) has no influence whatsoever on the current and future design, contents or authorship of the pages linked/inter-connected. It therefore explicitly distances itself from any contents of any pages linked/inter-connected that were altered after the links had been set. This statement applies to all links and cross references set within its own Internet offer as well as to foreign entries in the guest books, forums for discussion and mailing lists established by SAS (Security Advisory Services). It is the provider of the page that was referred to, not the one who merely refers to the respective publication via links, that is solely responsible for illegal, faulty or incomplete contents and, in particular, for damages incurring due to the use or non-use of such information furnished.
- Copyright and Trademark Law
SAS (Security Advisory Services) strives to observe in all its publications the copyrights of the graphics, sound documents, video sequences and texts used or to make use of the graphics, sound documents, video sequences and texts designed by SAS (Security Advisory Services) itself or to rely on graphics, sound documents, video sequences and texts that require no licence. All registered brands and trademarks mentioned within the framework of the Internet offer and protected by third parties, if applicable, are, without exception, subject to the terms and conditions of the respective trademark law in force and the rights of possession of the respective registered proprietors. A mere mentioning [of the trademark and brand names] does not mean that brand labels are not protected by third-party rights! The copyright on published objects drawn up by SAS (Security Advisory Services) itself remains solely with SAS (Security Advisory Services). The copying or use of such graphics, sound documents, video sequences and texts in other electronic or printed publications is not permitted without the explicit approval of SAS (Security Advisory Services).
- Data Protection
If it is possible to enter personal or company details [e-mail addresses, names, addresses] within the framework of the Internet offer and the user decides to do so, the disclosure of these data by the user is expressly voluntary. It is permitted to make use of and pay for any services offered – as far as technically possible and reasonable - without giving such details or by anonymising data or using a pseudonym. The use of contact details such as mailing addresses, telephone and fax numbers as well as e-mail addresses, published within the framework of the imprint or similar categories, by third parties for the purpose of sending information not specifically asked for is not permitted. We reserve the right to take legal action against the senders of so-called spam mails in the event of a violation of this prohibition.
- Legal Validity of this Exclusion from Liability
This exclusion from liability is to be regarded as part of the Internet offer in which this page is made reference to. If parts or individual wording of this text are not, no longer or not entirely in accordance with the law as it stands, this shall not affect the contents and validity of the remaining parts of the documents.
